Castro Theatre contractor sued for alleged ‘badly botched’ renovations ⁠34%

The Castro Theatre reopened in February to fanfare after a $41 million renovation, but behind the scenes, the venue’s operators have alleged that the construction company botched the work and overcharged. 
Another Planet Entertainment and its affiliated companies on Monday filed a lawsuit against general contractor Alarcon Bohm and its principal, Kevin Bohm, accusing them of shoddy construction work. 
On top of that, Another Planet claims the contractor illegally promoted its work on the Castro and two other venues even as problems became apparent. 
The suit, filed in San Francisco Superior Court, alleges trademark infringement, false association, false advertising, and unfair competition. 
Another Planet is joined in the suit by related entities that operate the Bill Graham Civic Auditorium and Oakland’s Fox Theater. 
According to the complaint, Alarcon Bohm performed defective and incomplete work during the Castro Theatre’s renovation, failed to pay subcontractors, and submitted bills exceeding the project’s guaranteed maximum price by millions of dollars. 
Repair and delay costs tied to the contractor’s work were estimated at more than $5 million, the lawsuit states. 
The construction went on for two years and turned the beloved movie palace into a modern multipurpose performance venue. 
“Shortly after the venue reopened in February 2026, it quickly became apparent Defendants badly botched the renovations, as well as management of the project,” the lawsuit states. 
“Extensive roof leaks damaged the historic ceiling, recently renovated, causing portions of it to collapse on the balcony.” 
The bungled work on the 104-year-old theater also included faulty drainage and improperly installed HVAC equipment, the complaint says. 
Other aspects of the project were not completed, though Another Planet claimed to have paid for the services. 
The lawsuit accuses Alarcon Bohm of using photographs, names, and trademarks tied to the three venues in its marketing materials, on its website, and in social media posts to suggest an ongoing, positive relationship with Another Planet — despite receiving cease-and-desist letters June 30 and July 13. 
“Another Planet Entertainment has spent decades building a reputation for presenting exceptional live entertainment and preserving some of the Bay Area’s most treasured cultural landmarks,” CEO Gregg W. 
Perloff said in a statement. 
“We cannot allow a contractor accused of defective work, excessive billing, and failing to pay subcontractors to use our venues and reputation to promote its business.” 
Perloff said the Castro Theatre remains open and safe for guests and performers, but Another Planet should not have to bear the cost of fixing work it paid the contractor to complete. 
The lawsuit seeks compensatory and punitive damages, restitution, disgorgement of profits, and attorneys’ fees, along with a court order barring Alarcon Bohm from using the venues’ names or images in its advertising. 
It also includes indemnity claims tied to unpaid subcontractor liens filed against the Castro Theatre project. 
Alarcon Bohm did not respond to a request for comment.
